A petition to John Wrake's second petition to The Queen, which discusses theft of birthright, raises a fascinating constitutional point.
THE SECOND PETITION OF JOHN WRAKE TO HER MAJESTY QUEEN ELIZABETH II Dated 5 November 2008 May it please Your Majesty, I submit this, my second petition for justice at your hands, on the following grounds: 1. As I stated in my first petition to Your Majesty, at your Coronation in 2. Your supremacy in legal matters is witnessed by the fact that all 3. Such Bills as come before both Houses of Parliament cannot be enacted until such time as they receive Your Royal Assent. 4. The provisions of the Treason Act 1795 and of the Treason Felony Act 1848 make clear that it is treason to attempt to overthrow the British Constitution and/or to attempt to deprive the Monarch of her rightful place at the head of this nation. The justice which I seek at your hands relates to the criminal offence of theft. According to English law, theft is the action of taking from someone what is rightfully theirs, with the object of permanently depriving the rightful owner of it. The theft which is the subject of this petition is of more importance than any loss of material possessions. It is the theft of my birthright. The exact nature of my first petition to Your Majesty is now irrelevant, since Royal Assent to the Lisbon Treaty has been given in Your Name. Nevertheless, the parts of that petition which referred to my status as English and an undoubted inheritor of the freedom under the law, won by my ancestors and others, still stand. I do not need to repeat them here, nor do I need to repeat the historical facts and the nature of my birthright which I set out in my first petition. What I must repeat is the fact that my birthright has been, and is being, stolen. That theft, contrary to Common Law, will be made legal unless the previous perverse, illegal and treasonous legislation, enacted by Your Ministers in Your Name, is overturned. Since logic demands that offences under the Criminal Law cannot be made legal while the English Constitution is upheld and You have promised to rule in accordance with our laws and customs and cause Law and Justice, with Mercy, to be executed in all Your judgements, I ask that You take such steps as will return to me my rightful inheritance. I repeat that I am not a member of any political party. I ask on the grounds of your oath to your people and my oath of loyalty to the King, your father, his heirs and successors. I remain, Your Majesty, Your most humble and obedient servant, John Wrake A second letter regarding his birthright 24 February 2009 Her Majesty, Queen Elizabeth II Madam, Since I have received no acknowledgement of your receipt of the second petition which I sent to you in early November 2008, I take the liberty of enclosing a copy of that petition for your information. Since Mrs. Bonici informed me that the letter accompanying my first petition to you in March 2008 was passed to The Foreign and Commonwealth Office, but made no mention of the petition, I wrote again on 2 May 2008, again setting out the grounds on which my petition was based. In her reply of 25 July 2008, Mrs. Bonici assured me of the careful note which you have taken of the views which I have expressed regarding the terms of this country’s membership of the European Union and the democratic authority of your Government. She does not, however, address the matter which gave rise to my petition, namely, the theft of my birthright. In my letter to you of 14 August 2008, to which I have not received an acknowledgement, I drew attention to the fact that my plea for redress against the theft of my birthright had neither been granted nor refused, but simply ignored. The personal contract between Sovereign and Subject, inherent in your Coronation Oath and my Oath of Allegiance, should be the safeguard of my birthright, set out in the English Constitution, of freedom under the same law, to which we are both subject. No government minister, no statute, no treaty can break a personal oath, freely made and openly undertaken while both parties hold fast to their promise. It is on the basis of those personal promises which you and I have made to each other that I submit my second petition for the theft of my birthright to be prevented.
